Client Materials

All text and image content required for the project, except where specifically stated within this quote, should be provided in acceptable digital format to Power Creations when requested, or additional charges may apply. The estimated duration to complete a website will begin once all the content material is supplied in the required format specified by Power Creations.

Power Creations is not responsible for rewriting of content supplied by the client, unless specifically contracted to do so.

Estimated Fees

All estimated fees, production charges and expenses apply only to the job description. Any additional features required will incur further costs. Currency of transaction is Australian Dollars only.

Scope Changes

Any variations from the original scope of this quote and specifications document will be charged to the client. “Variations” are considered to be modifications or additions that are supplied after the sign off from the client. Changes to content, that have previously been accepted as correct by the client, will be charged additionally. Our product is delivered when client signs final satisfaction document.

Payment

Payment is to be made in full within 14 working days of invoice.

Copyright remains the property of Power Creations until payment is made in full.

Non-payment may result in retraction of any right to use copy written material. A debt collection agency may be used once an invoice is 14 days overdue, and any agency fees, legal costs, or other expenses incurred in collection of an outstanding account will be payable by the client. Our website supports Secured Sockets Layer (SSL) based transactions from a browser to the level of at least 128 bit or greater.

Termination

Termination must be advised in writing. Power Creations reserve the right to terminate the project if the project is delayed by client inactivity for a period of greater than 2 months, or charge a project recommencement fee.

Deposit and refund policy

A 50% deposit will be paid by the client, before the commencement of the work to Power Creations.

This deposit is non-refundable. Any project in the work in progress stage that started but not completed will be evaluated by Power Creations on a case by case scenario and discussed with the client for a refund option.

Warranty

Power Creations undertake to correct any repair to programming code that causes an operational error, if advised in writing by the client within 30 days of invoice to the client. This warranty does not cover errors caused by third party software or if the client has altered the provided code.

Jurisdiction

These Terms & Conditions shall be governed by the laws in force in the State of Western Australia, and Power Creations and the client hereto submit to the exclusive jurisdiction of the Courts of that State.
